Caro had been living in Miami after being arrested three times by the regime in Caracas. He was initially charged with treason, possession of military weapons and US currency. The judge who ordered the arrest later admitted that the charges were based on fabricated allegations and apologized to the opposition leader before defecting to Colombia.

The arrests took place while Caro was a member of the Venezuelan National Assembly, even though his position gave him immunity from prosecution.
