Philadelphia prosecutors are cracking down on Elon Musk’s America PAC’s “election lottery.”

There was a point not long ago where Elon Musk said he intended to keep his wallet closed in the 2024 election cycle. The conspiratorial billionaire eventually changed his mind and began investing heavily in supporting Republican candidates throughout all election cycles.

In fact, the world’s richest man even helped found a super PAC that, among other things, created a $1 million “lottery” of sorts: If you’re registered to vote in a battleground state and are ready By signing an America PAC petition, you too could receive a seven-figure check.

If this doesn’t seem entirely legal to you, you’re not alone. As my MSNBC colleague Lisa Rubin explained, “a group of former Republican Justice Department officials even asked Attorney General Merrick Garland to open an investigation” because federal law already prohibits anyone from paying anyone to vote or even registering to vote.

We don’t know for sure if that happened or ever will, although the Justice Department’s Public Integrity Division reportedly contacted America PAC and warned that these giveaways could conflict with federal election law.

The Philadelphia district attorney’s office has apparently gone one step further. NBC News reported:

Philadelphia District Attorney Larry Krasner is suing Elon Musk and his super PAC to block their multi-million dollar giveaway to registered voters to stop the lottery-like ploy that election experts and the Justice Department have warned could violate federal law. Krasner is seeking an injunction: He argued in a filing that the attempt was an illegal, unregulated lottery, while avoiding the question of whether it violated vote-buying laws.

“America PAC and Musk are luring citizens of Philadelphia – and others in the Commonwealth (and other swing states in the upcoming election) – to give up their personal identification information and make a political pledge in exchange for a chance to win a million dollars. This is a lottery,” the lawsuit says. “And it is undeniably an illegal lottery. Under Pennsylvania’s clear law, all lotteries in Pennsylvania must be regulated by the Commonwealth of Pennsylvania.”

An attorney representing America PAC did not immediately respond to NBC News’ request for comment on the lawsuit.

Time will tell when and/or if a judge will schedule a hearing on this matter, although the local prosecutor is clearly pushing for quick action. Watch this area.
