Nebraska’s 12-week abortion ban remains in place

HASTINGS, Neb. (KSNB) – Nebraska’s 12-week abortion ban remains in effect after a majority of voters supported Initiative 434 and rejected Initiative 439.

Initiative 434, which restricts abortion after the first trimester, received more yes votes than Initiative 439, which sought to establish a constitutional right to abortion.

The abortion ban makes exceptions when a medical emergency requires it or the pregnancy results from sexual assault or incest.

Earlier in the night, Amanda Fraser of South Central Nebraska Right to Life said there is still work to be done regardless of the outcome.

“Of course we hope that 434 becomes part of the Nebraska Constitution, and we will continue to work to protect women and children in Nebraska so that this doesn’t stop no matter what happens,” Fraser said. “Education is our mission, and we are very fortunate to have a good group of Nebraskans who can help us do that.”

Nebraska is the first state to place competing abortion amendments on the same ballot since the U.S. Supreme Court’s 2022 Roe v. Wade repealed, ending a national right to abortion.
