An actor best known for his roles in “Arrested Development” and “Bob’s Burgers” was sentenced Monday to one year and one day in prison for his role in the attack on the U.S. capital on January 6, 2021.

Jay James Johnston, 55, was accused of joining a mob at the Capitol’s Lower West Plaza during the riot and filming with his cellphone. He pleaded guilty in July to a felony count of rioting.

Prosecutors also alleged that Johnston filmed from the stage set up for Joe Biden’s inauguration. According to court documents, Johnston also briefly held a stolen police riot shield and joined a group effort to target police guarding an entrance to the Capitol.

Prosecutors said Johnston “joined a group push against police in the tunnel, pinning a Metropolitan Police Department officer between the crowd and a door.”

The Justice Department had asked the judge to impose an 18-month prison sentence, saying Johnston neither regretted nor accepted responsibility for his actions.

Shortly after Jan. 6, Johnston initially downplayed the scuffle in text messages to a coworker, investigators said, writing, “The news portrayed it as an attack. It actually wasn’t.”

His lawyer urged the judge to impose a lenient sentence, saying prosecutors had “persistently overstated” Johnston’s role in the attack “because he is a celebrated Hollywood actor and the government is using his status to make a message to the public.” to put.”

Johnston was also ordered to pay $2,000 in restitution.
