Judge orders Trump to stop playing Isaac Hayes’ song at campaign rallies | Donald Trump

A judge on Tuesday banned Donald Trump from playing a song by the late soul singer and composer Isaac Hayes at his rallies – at least while a lawsuit by the artist’s family for a permanent injunction is being considered.

The temporary restraining order issued by federal judge Thomas Thrash in Atlanta, Georgia, prohibits the Republican presidential candidate from further use of “Hold On, I’m Comin’.” The song was written by Hayes and David Porter and was a 1966 hit by Miami-based soul duo Sam & Dave.

The injunction does not require the Trump team to remove videos from the internet of previous events where the song was played as the former president’s farewell music. The injunction will remain in effect pending the outcome of the Hayes family’s broader lawsuit.

A growing number of artists have asked Trump in recent months to stop playing their music at events and threatened legal action for unauthorized use. They include Abba, Jack White, singer of the White Stripes, Céline Dion and Johnny Marr of the British band The Smiths.

Isaac Hayes III, son of the artist who died in 2008, praised the verdict.

“We are very grateful and happy with Judge Thrash’s decision… I couldn’t ask for a better decision. I want this to also provide an opportunity for other artists to come forward who do not want their music used by Donald Trump or other political actors,” he told reporters, according to Deadline.

Ronald Coleman, a lawyer for the Trump campaign, said Hayes’ song would no longer be used anyway.

“The campaign had already agreed to cease further use. We are very grateful that the court recognized the First Amendment issues at stake and did not order the removal of existing videos,” he said, according to a New York Times report.

Trump’s lawyers argued that Hayes’ estate was not the licensee of the song and that he had permission to use it. Lawyers for the Hayes family called that statement “erroneous.”

Trump has been using “Hold On, I’m Comin'” for at least four years, violating copyright at least 134 times, according to the lawsuit. After one such use at the 2022 National Rifle Association convention in Houston, Texas, Porter tweeted: “Absolutely not! I did NOT and will NOT approve of them using the song for his purposes!”

Singer Sam Moore of Sam & Dave sang America the Beautiful at Trump’s 2017 inauguration concert. In 2008, he urged then-Democratic candidate Barack Obama to stop using his song Soul Man at campaign events, but sang the song for Obama at the White House five years later.
