The Brazilian Congress continues the challenge to the Supreme Court

Congress continues the case against the Supreme Court

There was once an old saying in Brazilian politics: A court ruling must not be questioned, only obeyed. But try telling that to the Brazilian Congress. On Wednesday, the House Constitution and Judiciary Committee, led by a right-wing congresswoman, approved two bills that would amend the Constitution and limit the powers of the Supreme Court.

  • Injunctions: The individual powers of judges to issue interim injunctions are drastically restricted. The bill aims to prohibit judges from overruling laws or decisions made by other branches of government.
  • Reversal: The Second Amendment is even more problematic because it would allow Congress to overturn Supreme Court decisions if lawmakers believe judges have exceeded their jurisdiction. With a two-thirds majority in each chamber, Congress could suspend decisions – the ruling said…
