LAS VEGAS (AP) — Former Las Vegas Raiders head coach Jon Gruden will receive a full review of a Nevada Supreme Court lawsuit he filed against the NFL over emails leaked to the media before he returns in 2021 dropped out of the team.

The state’s highest court is not planning oral arguments but said Thursday that all seven justices will reconsider their findings after a panel was split 2-1 on the May 14 decision to dismiss the case. The same three justices rejected a request for reconsideration by Gruden’s lawyers on July 1 by the same 2-1 majority.

The panel ruled that the league could move the civil case to arbitration, possibly overseen by a defendant, NFL commissioner Roger Goodell. Two judges said Gruden knew when he signed his contract with the Raiders that the NFL used arbitration to resolve disputes. The dissenting judge said it would be “outrageous” if Goodell settled a dispute in which he was named as a defendant.

Attorneys for Gruden, Goodell and the league did not immediately respond to email messages Friday. NFL spokesman Brian McCarthy declined to comment.

Gruden’s lawsuit alleges that Goodell and the league pressured the Raiders to fire Gruden by leaking emails containing racist, sexist and homophobic comments that Gruden made about Goodell and others while he was an on-air analyst at ESPN sent in the NFL. Gruden resigned from the Raiders in November 2021.

The NFL appealed to the state Supreme Court after a Las Vegas state judge in May 2022 rejected the league’s requests to dismiss Gruden’s lawsuit entirely or order out-of-court discussions that could be overseen by Goodell.

The judge referred to Gruden’s accusation that the league intentionally leaked only his documents. She said a jury could decide this was evidence of “specific intent” or an act intended to bring about a specific result.

Gruden was the Raiders’ head coach when the team moved from Oakland, California to Las Vegas in 2020. He is seeking financial damages and claims that the selective disclosure of the emails and their publication by The Wall Street Journal and The New York Times ruined his career and endorsement deals.

Gruden coached the Raiders in Oakland from 1998 to 2001, then managed the Tampa Bay Buccaneers for seven years and won a Super Bowl title in 2003. He worked as a TV analyst for ESPN for several years before being re-hired by the Raiders in 2018.
